Trade dress also is terminology for the exact files used in licensed packaging. Usually “Trade dress” refers to a lower element which would surround the bottom of the package and have information like the contents and any applicable warnings. Usually the rest of the package is covered by background branding. This is how licsensed goods retain a branded feel. A lot of fakey merch is put out using these files and flicking off layers in the photoshop files to change it a little.

Can you trademark any name?? For example I’ve heard that Hasbro lost their right to call a toy “Hot Rod”. So they renamed him Hot Rodimus. But my point is “hot rod” is a proper term for customized cars right?! So can you really own a name/term like that?
